This document is an 1859 Appellate Brief from the District Court of the Third Judicial District to the Supreme Court of California. It details the conflicting claims to lands that belonged to the Rancho Rincon de los Esteros, an 1839 Mexican land grant to Ignacio Alviso by Governor Juan Bautista Alvarado. The Rancho was located within present day Santa Clara County at the southern shore of San Francisco Bay between the Guadalupe River and Coyote Creek outflows into the Bay. The brief was written by Wm. Matthews, and argues the case law governing the legal status of previous sales of particular parcels of land from the original land grant. In the meantime, the text offers clues as to the life and times of Juan Ignacio Alviso (1772-1848), the original grantee, and his heirs and successors. Alviso was born in San Miguel de Horcasitas in the Mexican state of Sonora, and, at three years of age migrated with his parents Corporal Domingo Alviso and Maria Angela Trejo to California in 1775 with the de Anza Expedition to San Francisco. This document demonstrates the difficulties encountered by Californio property owners under the new regime ushered in by the American conquest of California. Not in Worldcat.
